General Terms And Conditions for Couriers in Lithuania

These general terms and conditions (the “General Terms”) apply to all relations between you (“You”, “Your”) and Vok Bikes (Optigon OÜ, registered in Estonia, registry code 14424376, with the following local contacts: address A. Juozapavičiaus 6, Vilnius 09310, Lithuania, telephone +370 627 30411, email [email protected]) regarding the rental of Vok S electric cargo bikes (the “Vehicle”).

By accepting these General Terms, you agree to their application and content and to the processing of your personal data disclosed during registration on the booking platform provided by Cachet OÜ (the “Booking Platform”) under the conditions set out in these General Terms.

The services provided by Vok Bikes include the rental of the Vehicle and all related equipment, personnel, services, applications, websites, and information provided or made available by Vok Bikes (collectively, the “Vok Bikes Services”).

1. General Conditions

  1. You will be the sole renter of the Vehicle and are solely responsible for compliance with these General Terms.
  2. You may not hand over the Vehicle to third parties without the written permission of Vok Bikes.
  3. You must be at least 18 years old to rent the Vehicle.
  4. You must follow all local laws, traffic rules, and regulations when using the Vehicle.
  5. You are fully responsible for the safe use of the Vehicle at all times and accept all associated risks.

Prohibited Use
 You must not:

  • Use mechanical or electronic devices that distract you from safe operation.
  • Operate under the influence of alcohol, drugs, or other impairing substances.
  • Carry passengers.
  • Use the Vehicle outside the permitted operating area shown on the Booking Platform.
  • Use the Vehicle for racing, stunts, or extreme riding.
  • Ride off-road (including mountains, forests, unpaved roads, or through water).
  • Park in prohibited or unsafe locations, or in ways that disturb traffic.

2. Account and Bookings

  1. You must register on the Booking Platform to make rentals and provide accurate, complete information, including payment details.
  2. You must keep your account details confidential and inform Vok Bikes immediately of any unauthorised use or security breach.
  3. All rentals are personal and only you may collect and operate the Vehicle.
  4. Rental lengths, availability, and prices are displayed on the Booking Platform.
  5. Cancellations must be made through the Booking Platform within the timelines specified there.
  6. You must present valid identification when collecting the Vehicle.

3. Fees and Payment

  1. All rental fees must be paid in advance via the Booking Platform.
  2. Payments are processed by an authorised third-party payment processor.
  3. By providing your payment method, you authorise Vok Bikes to charge you for rental fees and any other amounts payable under these General Terms.
  4. Payment disputes must be reported to Vok Bikes within 10 business days of the charge, with relevant booking details.

4. Use of the Vehicle

Conditions of Use

  1. You confirm you have received onboarding instructions from Vok Bikes staff, understand how to operate the Vehicle, and are physically fit to do so.
  2. You are responsible for assessing weather and traffic conditions before and during operation.

Safety Check
 3. Before each rental, you must visually inspect the Vehicle to ensure it is safe and roadworthy, including:

  • No visible damage or missing parts;
  • Adequate tyre pressure;
  • Working lights;
  • Properly adjusted mirrors;
  • Brakes functioning effectively.
  1. If defects are found, you must notify Vok Bikes before use.

Collection and Return
 5. You may collect the Vehicle at any time during your rental period, within the working hours of the designated Vok Bikes hub stated in your booking confirmation.
6. You must return the Vehicle to the same hub by the agreed end date/time. Late returns may result in penalty charges displayed on the Booking Platform.

Loss or Theft
 7. You are responsible for the Vehicle from collection until return.
8. Loss or theft must be reported immediately to Vok Bikes and, if requested, to the police.

Tracking
 9. Vok Bikes may track the location and route of the Vehicle at any time for operational, safety, and theft-prevention purposes.

Usage Standards
 10. Operate the Vehicle carefully, economically, prudently, and in accordance with safe and responsible riding practices, the purpose of the Vehicle, and these General Terms.
11. Park only in legal, safe locations with the handbrake engaged.
12. Do not exceed the Vehicle’s maximum load capacity.

5. Damages and Liability

  1. You must not repair the Vehicle yourself or through third parties without written authorisation from Vok Bikes.
  2. You are liable for damage caused by breach of these General Terms, negligent or reckless use, or failure to follow safe riding practices or traffic laws.
  3. Vok Bikes may charge you for:
    • Repair or replacement costs (based on Vok Bikes’ official spare parts list);
    • Labour and recovery costs;
    • Administrative fees related to damages or legal claims.
  4. You are liable for third-party damages caused during your rental unless covered by valid MTPL insurance.
  5. You must reimburse any costs or deductibles not covered by insurance.
  6. All amounts must be paid within 14 days of written notice from Vok Bikes.

6. Insurance

Mandatory Motor Third-Party Liability (MTPL) Insurance

  1. You are responsible for arranging and maintaining valid MTPL insurance for the Vehicle for the entire rental period when required under Lithuanian law or the laws of the country where you operate the Vehicle. For the purposes of obtaining MTPL insurance where required by law, you will be deemed the keeper of the Vehicle for the duration of the rental period.
  2. You must obtain such coverage at your own expense before collecting the Vehicle and provide proof to Vok Bikes upon request.
  3. Failure to provide proof when required may result in cancellation without refund.
  4. Without the required MTPL insurance, you are personally liable for all damages, losses, injuries, and claims arising from your use of the Vehicle.

Property Damage Insurance
 5. Vok Bikes maintains property damage insurance covering up to €5000 for damages to the Vehicle caused during your rental.
6. You must pay a deductible of €550 per incident for claims under this insurance.
7. If the repair cost does not exceed the deductible or exceeds the €5000 limit, you must cover the difference in full.
8. This insurance covers only damage to the Vehicle itself and does not include third-party damages, theft, or loss unless specifically stated in the policy.

7. Intellectual Property Rights

  1. All intellectual property rights in the Vehicle, its design, technology, branding, and any developments are the exclusive property of Vok Bikes.
  2. Nothing in these General Terms grants you rights to use, copy, modify, or reproduce the Vehicle or its components.
  3. You may not use the Vok Bikes brand, logo, or name in commercial activities without written consent.
  4. If you share media featuring the Vehicle with Vok Bikes, you grant Vok Bikes a royalty-free, worldwide, non-exclusive licence to use it for lawful purposes.

8. Cancellation and Suspension

  1. Vok Bikes may cancel a booking without liability if:
    • Weather or safety conditions make operation unsafe;
    • The Vehicle becomes unavailable due to breakdown, theft, or other unforeseen issues;
    • You fail to meet the requirements in these General Terms.
  2. If Vok Bikes cancels before your rental starts for reasons not caused by you, you may receive a refund or alternative rental period.
  3. Vok Bikes may suspend or terminate your rental immediately and without refund if:
    • You breach these General Terms or applicable laws;
    • You cause damage to the Vehicle through reckless or negligent use;
    • You operate the Vehicle without legally required MTPL insurance;
    • You engage in fraud or abuse.
  4. Upon suspension or termination, you must return the Vehicle immediately. Costs for recovery will be charged to you.

9. Final Provisions

  1. Vok Bikes may update these General Terms at any time. Updated terms will be published on the Booking Platform and apply to future rentals.
  2. Vok Bikes may change or discontinue parts of the service at any time without prior notice.
  3. The Booking Platform and services are provided “as is” without warranty of uninterrupted availability.
  4. The processing of personal data is described in the Vok Bikes Privacy Policy available on the Booking Platform.
  5. These General Terms are governed by Lithuanian law. Disputes will be resolved in the competent courts of Vilnius, Lithuania.
